The decision, issued by Brian Murphy, places a preliminary injunction on key parts of the proposal, including efforts to restructure the advisory body that helps guide national immunization recommendations.
At the center of the dispute is the role of the Centers for Disease Control and Prevention and its advisory group, the Advisory Committee on Immunization Practices. The court found that the agency did not follow proper legal procedures when attempting to revise the vaccine schedule earlier this year. Specifically, the ruling points to concerns about how changes were introduced without sufficient consultation and whether the advisory panel itself had been lawfully reconstituted.
